Can an employer tell you they are downsizing and lay you off when they are really not downsizing?

Yes! Firing you could be the downsize.

Unless there is some form of discrimination being done an employer can fire you anytime they want. They can come up with any form of just cause if the want to as well.

Of course. The benefit for you is that you get unemployment if furloughed (laid off).

In some circumstances, employers have been found guilty of discrimination and/or unfair labor practices by courts. These types of allegations are extremely difficult to prove. Only an attorney could advise you in that regard.
