Can I sue a school for negligence, for not giving my child his asthma medicine for over a month?
My son has severe asthma, and has not been in a green zone for as long as I can remember. His doctor gave him medicine he is supposed to take twice a day while at school, then diffrent meds while at home. Recently he started haveing some behavioral issues in school, and I was called in to confrence with the principal. She "suggested" my son be sent to therapy, and I told her I didnt think he needed it. soon after leaving that meeting the school called CPS on me stating I was denying him mental health treatment. CPS told me i was doing nothing wrong and closed my case. after this I decided to visit the school nurse and see if everything was ok, and found that she had not given my son his medication for over a month. (last dose was 1/3/12 today is 2/25/12)So my son is having trouble in school because he cant breathe properly. Can I sue the school for negligence? I plan to report the nurse to the state board.
