I am a US citizen getting ready to marry a illegal. Is it better to go to his country and get married and file for him to be a us citizen

I have been with this man for over a year and we want to get married. Is it best we go to his country and get married and then come back to the U.S. and file for him to become a citizen? Or just get married here in the US and file for his papers. I guess I want to know which way is faster?

Getting married is not the problem.. That's easy.. I just am not sure if I need to get married there so he can become a citizen faster here. Where if we get married here and file then we have to file differently. He has been here three years and he is from Honduras.

I went through this with my wife and if we had married in her country she couldn't come back to the US and would have to wait until her Visa came through which took 5 months.

You marrying him will NOT make it legal for him to be here. He still has to go through the same process, which is not a quick process. If he is caught being here illegally, even married to you, he will go to jail. I have a friend who did just that and her husband has been in Texas jail for over a year now. Once deported for being here illegally they are barred for 10 years from returning to the US. Please read this article. Marriage before making it legal will not solve anything.

Not true

It is true. If she marries him in the US and he is here illegally, he is still illegal. If he is caught, he will be taken to jail and face serious repercussions.

It is absolutely not true. They are not just getting married so he can stay here. They love each other. That is not a crime. If there are questions, of course there will be an investigation into motive behind the marriage. People who come to this country have rights whether alien or not. They don't just get taken to jail. Especially if he's filing for citizenship. If he does so before his visa expires then he IS LEGAL!!!!!

This has nothing to do with if they love each other. It is a fact that even if they are married, he gets taken away if he is caught here illegally. He has no rights if he is not here legally. It us sad, but true. Do the research. I did and I have a close friend that this just happened to. Her husband is being detained in a Texas jail, for being here illegally even though married with 4 kids together. I am not wrong. Love has nothing to do with what's legal.

She said he is here illegally, so he has no visa.

cbratcat - I see that and I need to correct myself and appologize to you. I don't know why I missed the part in your response that said if she marries him in the US "and he is here illegally", but I missed it and I stand corrected. I'm sorry about being argumentative but I thought you weren't getting the point. Turned out, it was me that didn't get it. My bad. Sorry again.

Thanks and apology accepted. We all make mistakes.

Your marriage will not make him a citizen. If he is illegally here then your marriage will not make him legal and they will not forgive and forget. If it were me, I would travel to his home and apply for a fiance visa.

Definitely get married in the US, so that he can stay here legally.
