The passenger got into a car with an impaired minor. The almost killed my wife and myself traveling at 3x the speed limit. I'm wondering if the passenger can sue the driver?

Of course this begs the question, why would one get into a car when the driver is drunk?

The passenger with the drunk driver suffered very serious injures. I think he wants to sue the driver but I'm wondering if he can do this?

I think there's a good chance he might be able to sue. I would hope a court would assign some responsibility to that person that got into the car who's driver was drunk.

Why did they get into the car knowing that the driver was under the influence? They had a choice. The car that got hit did not. If I was the judge or on the jury I would say no. But any medical claims should be covered by the drivers insurance.

I'm worried the passengers claim is going to take up some of the insurance benefits available to me and my wife. We were seriously injured. Bones were sticking out through my leg. My wife had seat belt cuts which required surgery. The passenger thou had a shattered pelvis internal bleeding and 9 broken ribs. Maybe more I'm not sure. But you are right he had a choice

I would think that each claim would be separate. I don't think that there is a lump limit for the accident. All injured parties should be covered for there medical needs. The passenger needs his head examined too.

I think the driver is lucky that he had insurance if he had a DUI and a suspended license. I think all victims can sue.
