How do I make sure I get what I need from my divorce without making it messy?

My husband and I will be married 5 years in September. On June 21st I found out he is cheating and he moved out of our apartment until I can gather my belongings and move to my parents. I work part time and he works full time. We only have money to split and we have a car loan out. We are trying to keep costs down by not involving lawyers because we want to have some money in each of our hands after the divorce. We are not filing for divorce until January so I have plenty of time to find a full time job before being kicked off his insurance. The only thing I really want or even need is some type of help or compensation for the car. My husband has a work truck and personal truck and has no need for another truck. I don't think we qualify for any type of alimony paid out and I don't want it. I don't want his 401k. I just want to make sure the car is covered and cut my losses. I'm beyond angry at the circumstances of our divorce and would love to rake him through the coals but 2 wrongs don't make a right. I'm asking for out of this is not to file until January so I have time to find a full time job with no lap in health insurance and some type of help with the car.

Sorry about your circumstance. The best thing would be to seek advice from a qualified attorney about what you can and cannot receive as compensation for your divorce. Sometimes lawyers will not charge for this if you explain your situation, another possible help is a friend in the business or family. This is also a cheap way to get free legal advice. Those both sound like reasonable requests and the trade off of not wanting a share of his 401k is seemingly reasonable too given the short length of the marriage and your age. You are wise not to try to battle this out in court and stick it to him. It would only cost ridiculous amounts of money with little satisfaction gained. I would ask for recommendations from friends and interview several lawyers..Most do not charge for the initial consultation and it allows you to see who you think is like minded and you trust. Good luck! Been there.

There are also mediators which can be cheaper than attorneys. If you tell him that in exchange for not asking fir 401k or alimony, you want compensation for thecar, he should jump at it! Don't know if your state has "no fault" divorce or not, but that could be another factor in the process.
Gone thru it. Hate it. Very smart of you to think abt insurance. Be specific: KEEP PRESENT POLICY ONLY! my agreement said he would keep insurance on me but the jerk turned around & got me $10,000 deductible insurance!
