How bad do your grades to legally have to go to summer school

If you are short of 4 or 5 credits for the year, you can make them up for the summer school to avoid repeating the whole year. The school will not consider you if you fail all year long or get grades below 65 in your class.

Legally is not the question. If your grades are that bad then you NEED to be in summer school.

I believe that your GPA in your core classes (not counting electives) has to be below a 1.5
