My vehicle became disable on the road I stayed in the vehicle w/emergency flashers on & was struck by another vehicle. I am uninsured.

Unfortunately I believe they will make the argument that you shouldn't have been driving in the first place. Of you weren't then there would not have been any accident. I bet this is what they will say. I know it stinks, especially since it was the other drivers fault.

I have documentation that my insurance was up to date but when I checked my brother defaulted on payments without my knowledge so I go to make a claim & find out I'm not insured smh!!

You're going to get a no insurance ticket, which is about $700. But the other car is at fault. Get their insurance info.

When police arrived I showed documentation that I had insurance but I just found out when I went to make a claim that my brother who is the policy holder defaulted on payments & was dropped smh!

I do have a insurance card claiming that my vehicle was insured until July everyone in the vehicle was injured & transported via ambulance

I didn't receive a ticket because state saw that I had proof of insurance card

The fact that you didn't have insurance has nothing to do with whether the other driver is at fault for your injuries and damages to your car. Your damages are due to the negligence of the other vehicle, and its insurance company will normally pay. However, if you are in a "no fault" state it may be more complicated. Without insurance, you have no one to stand up for you if (probably when) the other guy's insurance denies your claim. You will probably need a lawyer, which will cost more than insurance would have.

I was under thee assumption that my vehicle was insured I also have an insurance card stating that my vehicle was insured till July 2012 unfortunately my brother didnt make payments & insurance was cancelled however I had no knowledge that my vehicle wasn't insured furthermore my car became disabled on the xpress wayi had my hazard light flashing when my car was struck everybody in my car including children had to b transported by ambulance?
