Argument between restaurant Mgr. & waiter with facial piercing.

Witnessed fight in food joint. Employee (server) showed up for shift with a bleeding, badly swollen eyebrow piercing. (No bandage.) Mgr. asked him to leave & not return until healed. Waiter stormed out accusing discrimination. I think the Mgr. was correct to excuse the waiter; my friends think the Mgr. overreacted. Any thoughts?

Yes that is a food safety concern and if he did not want to put on the Band-Aid the manager has every right to remove any unsafe acts from his place of work so later he would not have to deal with frustrated customers and possibly a law suit if blood got on a plate or anything

The manager should have told him to put a band aid on it rather then sending him home. I seriously doubt he will be coming back. The employee should have known to put the band aid on themselves, this would have avoided the whole situation from happening. If nothing else it supports the concept that employers do take piercings seriously when considering employment.

And it doesn't matter even if it was descrimination... If it is private owned, then he can do anything he wants.

If I was a customer and saw him bleeding I would have loudly complain to his mgr.. Mgr was totally right to send him home

Guessing dustee probably means, "speak up" and not, "make a scene". Waiters/waitresses with tattoos & piercings may unwittingly spread hepatitis, thru food handling, if they're not aware they've been infected. I can understand this Mgr's concerns. Customer's too. Not to mention being unsightly. Piercings are a conscious choice to alter your looks, not an accident or birth defect. I don't think employees can accuse discrimination if a boss disapproves. Honestly, have no idea. Laws may say otherwise.

It's good you have backers, I guess I must have envisioned my sister complaining loudly (she swears too) when I saw that part. It really is embarrassing when she does that (and she's an older woman).

I think the manager was correct, the employee should have at least spent some time cleaning himself up and covering the injury, No one wants another persons blood in their food.
