Why isn't spider man in the Avengers?

The Avengers movie is based off of the origin story of the Avengers. Spider-Man doesn't join the Avengers for a long long long long long long time

Spider-Man is part of the Avengers but he wasn't there at the beginning. The Avengers movie is based off of the very start. Hence Spider-Man isn't there

He is an Avenger, but not one of the founding Avengers. Plus, I saw the movie and they forgot some of them such as Giant-Man.

Sony owns the rights to make spider man movies and marvel studios doesn't. the only way we'll be able to see spiderman in a avengers movie is if they pay Sony to let them use spiderman in a avengers movie.
