Can you sue a so call retailer store for giving you the wrong dress on purposely and make you miss out your prom night?

please i would like to get your feedback.

Can you yes, you can sue anybody. Should you probably not. I would think you would have a very hard time proving they did it intentionally. The other issue would be how much compensation do you want? If it was so important to you why did you not try it in in advance? Why did you not go out and buy another one. I am not trying to belittle you I just think these are the questions that will be asked of you. I just do not see it as a very strong case. Good luck if you do sue.

the thing is i was fit for a size 6 but they had a size 10 in the store which is the one i saw nd try it on then pay them to order the my size for me...they asked me to fix the size 10 and give it to me i said no i need a new one ..but then when i went to get the dress i try it on it didn't fit properly nd give it back to them to fit again which was suppose to be the size 6.after 2 days they call me to come nd pick it up then on my prom day which was yesterday trying to put it on that's when i relasize the bottom fit properly nd the top couldn't fit just because it was not really hte size 6 nd when i look at the tagg u can cleraly see that they took a pen nd turn the 10 to a 6 #so stupid of them

You can sue anybody for anything. The question is do you think you will actually win? What makes you think they gave you the wrong dress on purpose?

BTW the moral of this is always check what you are taking home before you leave a store.

their did it on purpose because they were too lazy to order my size for me nd just fix a bigger size they had at the store nd make it fit to my size..nd when u look at the tagg you can see how they change the number 10 to a 6 with a pen

Well, yes if they altered a dress to size it down they should have done so with a proper fitting, and that should have been explained to you at the time of purchase. They did not give you what you ordered, however I really don't think you will be satisfied with a law suit. By the time you pay court fees and everything you'll get very little money back. Have you tried returning the dress? If you ordered a size 6 and they gave an altered size 10 they should refund your money. If they don't contact your local TV news that does consumer protection stories and tell them. You should get your money back and they get the bad publicity.

But do take this as a life lesson. When you order something check it out throughly and try it on before leaving the store.

There is a great saying in retail..."caveat emptor"...which is Latin for "let the buyer beware". You need to CHECK the merchandise before you PAY FOR IT. They are not responsible for your prom; that's your problem for not planning ahead.
You are angry and disappointed; those are very understandable emotions. But don't be a person who blames others for your problems...use this VERY MINOR PROBLEM as a useful life lesson.

i'm not blaming them they knew that they couldn't get me the dress i want to have they could have just give me back my money.it's not fair to me when they go nd fix a fix a bigger size they had in the store and give it to me.

What DrDebit said. Its doubtful youd win such a suit unless you can prove the store did it deliberately, which i doubt. Esp since it didnt actually cause you harm.

Can you prove any of these allegations? You will need to prove that the store gave you the wrong dress on purpose and that you suffered because of their actions.
