Fifth degree theft is punishable by a fine from $65 - $625 or up to 30 days in jail. The charges will remain on your record until and unless it is expunged. If someone pleads guilty, this will result in a fine of guilt and a record of guilt. The case will then proceed and if the prosecutor will not drop the charge and if a favorable plea deal isn't reached, the matter will go to trial.
