Why did it take an act of Congress to establish the Supreme Court

A. The Constitution called for the establishment of a system of courts, but it did not provide a specific set of instructions for how that would be done.
B. President Washington could not decide who would sit on the Supreme Court.
C. The states could not agree on the number of justices that would serve on the court.
D. No act of Congress was required. The Supreme Court had been established under the Articles of Confederation.
