I recently sold a firearm to a gun dealer using my expired drivers licences. Is this a legal transaction, because of the expired i.d?

You need to check the gun transaction laws in your state - and county - a lot of states are getting pretty strict because of all of the illegal arms smuggled into the country - my take is that you'll be ok - as long as you have the required details on whom you sold the piece to - I'm assuming you have the serial number and the buyer's ID? I've got quite a few relatives in law enforcement - if your sold gun ends up as evidence in a crime - they'll be looking at the chain of custody - right back to where the gun was originally purchased. Since you sold this to a registered gun dealer - the obligation for obtaining the proper paperwork is on the buyer - if it were me - I'd contact the buyer and update him or her with a copy of your new ID - assuming you have one.

Thank you for your time! What i was wondering is can i get my firearm back because of my I.D being expired by a year. They had to of seen it was expierd!
I sold it yesterday so if I go in and ask for it back on cause of faulty paperwork do you think i woudl need a Police officer to keep it civle


I live in upstate ny syracuse. anymore help would bee awsome!

I'll try to give you my best advice, given the fact that we have to communicate in posts. Did you sell the gun to a gun-shop or a private party? Gun-shops have a bunch of legal requirements for buying and selling arms - owners don't want to lose their business licenses so they're pretty strict regarding what they need from you if they decide to buy your firearm. If this is the case with you - I'd give the owner a call and ask him if the sale was compliant with state / county laws - ask him if he wants you to scan and email him a copy of your renewed license (if you have one). The reason I'm advising you to do this is so that if the gun were stolen and used in, say, a robbery - and the gunman got caught with the piece with the serial number still intact - the police immediately check their databases of missing weapons - usually by serial number if one is available (criminals typically file them off) - you want the gun to be traced back to the gun-shop owner - who is legally required to report any missing arms. For your own protection - I'd keep the bill of sale - with the serial number, make, model, caliber, etc. in a safe place. The idea is that if the police investigate the chain of custody of the gun - you can show legal transfer of custody to the shop owner - which takes you out of the loop of any investigations (of course, if you've got a police record, this is even more reason you want your name cleared). I've seen myself that some gun dealers are really sloppy with paperwork - others will sell firearms to just about anyone with a wad of cash - so - to protect yourself - document everything - I would rent a safe-deposit box at a bank and keep these documents in them - you're probably well aware of how some people will say or do just about anything to make a quick buck - these documents will keep you from becoming a patsy - I hope this helps.

Seems to me the gun dealer wouldn't risk fines, prison and loosing his ffl do I'm going to say yes.

I'm pretty sure to buy or sell firearms you have to have valid ID
