If I want to remix and old video game theme, would posting it be legal?

I am working on a remix to the donkey-kong theme song, and I have no idea if Nintendo would sue me.

They would sue you for remixing the song. As long as it is a remix and sounds different from the original, you are safe. You can remix it and post it on YouTube and see what people think and they will rate your mix.
