Is this legal? My neighbor built a shed less than 2 feet from my garage and his roofing comes over to my property by 1 foot.NY Queens home.

You can call code enforcement to be sure, but my gut says it is illegal. Every where I have lived any water that comes off of ones building has to land on their property. If his roof is a foot over on your property (which I believe would also break code.) the water would land on your property unless he has gutters routing it to his property.

code enforcement deals with property maintenance issues such as garbage, derelict buildings, weed overgrowth but NOT lot line issues. these must go to the county building and permits department.

It varies as to where you live as to what dept, but for the picky, I should have said the building inspector.

building inspectors only get involved for phases of building after you have obtained permits to build. or if the city has properties that are for sale or possible condemnation situations, etc.not for property d8isputes. you have to go to permit and building regulations to 1. see if he took out a proper permit to erect the structure and 2. the regulations for placement and specs for the structure. this is where you have to start. the building inspector will charge YOU to do an inspection on any structure you call about weather it is yours or someone else's because you would be the one calling him and he isn't even the person you need. please check this out.

gatorblu, it has nothing to do with picky, you would be sending him to the wrong department and then he would have to go to another, wasting time and possibly money. while code enforcement has its responsibilities, and so does a building inspector, neither one of them do the jobs of the building, permit and planning department personnel, which is what he needs.its nice that you are trying to help, though, but I have been involved with all phases of construction for over 30 years and he really needs the department I mention. Its quick and easy to get their help, too.

Probably not legal. You would have to duke it out with an attorney to represent you.

dont need an attorney, just go to the building and permits department of your county and get the regulations for your county,city and block. then report the condition to that department and they will MAKE the neighbor rectify it or face a hefty fine. then and only then will you be able to sue for encroachment issues.

You do need to take care of it, for sure, because it will become an issue whenever anyone goes to sell your property.

I am researching and from what I have learned this violates the zoning laws and I will contact a lawyer to settle this.

If your neighbor built a shed less than 2 feet from your garage and his roofing comes over to your property by 1 foot, that is illegal. That can be taken as trespassing to a person's property. You can talk to a lawyer for more advice.

only a person/s can trespass. property is encroaching. must go to the county building and permit department and get county, city and block regulations for your area. then file a complaint with that department and let them cite the neighbor and handle it. they will make him rectify it or give him a hefty fine. then you can go to court after exhausting LEGAL proceedings first.if you don't got to the county first, you may make a misstep in court and end up with the neighbor winning on a technicality even when he is wrong.

no. check with your county on lot line encroachments. there are required limits of how far things can be built from the property line but they can NOT OVER HANG. THIS INCLUDES TREE BOUGHS. unless the neighbor benefits from the fruits of the tree and does not object.

AND WHERE YOU FIND THIS INFORMATION IS IN THE BUILDING AND PERMITS DEPARTMENT. this information is at the county offices in the planning, permit and building codes department. some of these departments are broken up individually but they are still identified as the same.

There must be no others' property over your property. If it annoys you, ask you neighbor to take it off, because it is absolutely illegal.
