My step-son who is 12 wants to live with us, but his Mom has primary custody do we have to make him go back? Or can we keep him til court?

if she has custody he has to go back or the court can find you in contempt and having committed custodial kidnapping. she can have the police remove him from your home by providing them the court order of custody and you WILL be sited, at least.and perhaps arrested. that will not look good in court and can cost you more visitation.

If his mom has custody, you have to send him back. Unless there is abuse, and you've gotten DHS's permission to keep him. You don't want to keep him otherwise, you could get into trouble and that could affect your court hearing. Good luck.
