is it possible to get my rights back to my daughter if my mom threatened me to sign my rights over? the adoption hasn't gone through

my baby is 18 months and was living with me the last 9 months but she just came & took her when she found out I wanted my custody back b/c she gets a large amount of child support from her husband. I have court on sept 7th. just wondering if there is hope b/c I don't have the money for a lawyer but I miss her terribly

You'd have to prove to the court that you are a fit mother and that it is in the Childs best interest to live with you.

No, the grandmother would have to prove that her daughter is an unfit mother, she doesn't have to prove she's a fit mother until she is accused (with supporting evidence) of being an unfit mother.

Well there you are wrong because the court has already said the child should live with the grandmother. So now the mother must prove she is capable of being the best caregiver for the child.

It is not clear to me what the status is with this case. Mom said she was forced to sign the adoption papers and it hasn't gone through, so I don't think it is a done deal.

Yeah that's what she said. I'm sorry but they haven't made a gun big enough for nevi be "forced" to sign over my rights to my children. Perhaps if I knew that if I was taken to court to get the custody of my children removed, and I knew the court would find out that my kids were not safe with me, I might be "forced" to sign away my rights to them.

Do not make yourself the standard of all people, because you are not "all people." The older I get, the more I realize that there are many, many circumstances and conditions out there that I have no concept of, and no idea of what I would do if those circumstances happened to me.

You have custody, not your mom.
She can not make you sign your rights over! Call the police and go get your child. There are free lawyers for people who can't afford one.

Always hope, GOD is with us. The court case for custody is based on best for child. Only my advice not a professional, think 3 steps ahead. Maybe because of yer age & economics your Mom may win custody for now. Focus on making you the best you. Establish yourself financially & you will prove yourself to be the best provider or caregiver to Your daughter. It's a tough shake, but U knew it wouldn't b easy. Bless!!! By the way Plz hate the sin not the sinner. Hate the need of money not the person who perceive the need. I'll pray for U! Keep your eye on the prize!!!

The court will indeed strive to do what's right for the baby. They assume that you are a fit mother and it will have to be proven that you are not before they can take your child. Our legal system is extremely reluctant to deprive natural mothers of their children, I'm not saying it doesn't happen, but it is not common. There are, indeed, court-appointed lawyers for people that can't afford them. There are even lawyers appointed to represent the babies sometimes. Since court is scheduled soon, show up and ask for a court-appointed lawyer if you can't find one sooner than court. Ask for your baby to be returned to your custody and you do not have to let your mother take the baby away from you. Please, think carefully about what's best for your baby. If you are on drugs/alcohol it might be good to let your mom have temporary custody. I do not know you or your circumstances, I just want you to know you have rights and so does your baby. See a lawyer, please.

How does your mom get child support from her husband if the little girl is your child? The father of the child has to pay child support. Now I don't see how she forced you to sign over your rights. Contact a lawyer ASAP.
