How to sue the state of washington

I was notified that there was information released by DSHS on my background check that denied me the ability to work in certain areas of employment. I was never convicted of a crime that fell under this area but there was a finding of fact that was listed as the reason. I requested a review of the report in October of 2010 and was told by a party that takes care of such reviews that I wouldn't hear anything back until November 22, 2010. The matter is still not resolved though many promises were made that resolution would be forth coming.. The most recent promise was that resolution would be sent to me by the 1st of August. when I received nothing by Friday of that week I called and again was "promised" that I would have the findings of the review by the following Monday and that if I didn't get any thing by that Wednesday that I was to call. I have been calling since that day almost every day only to be told that they weren't in or this person was busy and to leave a message and they would call back as soon as possible. I have left many messages to 3 different people who were involved in this review and haven't gotten an answer from any of them for the past 2 weeks. Answers ???

Staying focused on what you want to get out of this, I don't know that suing would guarantee that they would release that information any faster. However, if you want to go that route, the easiest way to file a suit against the State would be to have an attorney act on your behalf (otherwise you get caught up in a lot of legal proceedings that you may not know much about). Of course, being denied employment, chances are that the lawyer route might not fit your budget even if you won the suit.

All government agencies have hiccups in their communication and the chances are you have been transferred to multiple people in multiple departments, who may or may not have a clue about resolving the process. My suggestion would be to go in person (as grueling and obnoxious as this can be), and non-threateningly tell them that you need to see a copy of a background check that has been promised to you multiple times and not received. Calling and leaving messages, even friendly and polite ones, rarely gets me what I want out of a government agency, but sometimes showing up in person and assertively (but not aggressively) stating your purpose for being there can move things more quickly. It's easy to hang up the phone or ignore a message, much harder to be rude to you in person.

It isn't a problem in getting the information from them as far as what is on the background check. It is getting that false information changed. As for being transferred to multiple people I have been working with two who have promised me a decision, on 8/1/2011, then 8/10/2011, then on 8/17/2011. The last promise was given to me guaranteeing that I would get the results of the review by 8/262011. I got nothing and what is really getting me peeooed is that they won't even answer my many messages. It's like I don't exist to them once they have gotten me off the phone. I feel like the curly headed step child. The reason that I was asking about legal recourse is that I have been turned down for employment because of this false information that is a result of some overworked, overzealous social worker that must figure that if it came from the woman's side that it must be true. Then I have repeatedly lied to about how they are handling the review and when they will have the results. This has been going on since 11/22/2010 which was the first time I was promised the review would be finished in 2 to 3 weeks. Again I have been dealing with the same 2 people all along. I think that maybe now you get an idea about how I feel.

A P.S. to the last comment, When will there be an organization that represents men in DSHS in disputes?? There are woman's organizations that help in all manners of deputes. Men need support groups too and should not be deemed the monster when divorce proceedings use false abuse allegations to win custody issues. They will arrest you at a drop of the hat only to release you when there is no evidence to support the charges, but they can make the rest of your life hell with a report based on the same information. Where is the fairness in that?? I can't afford to pay an attorney and have not been able to find one that would take the case on a contingency basis.

I am truly sorry for your situation and that my answer was not helpful to you. I might suggest starting your own organization if you can be clear about its mission. It seems you are passionate about the issue(s), and if you are well motivated and believe in it, you could turn it into a very meaningful career. The sba in your city likely has a chapter with resources -- books and live humans -- who can help you define your mission and plan for success, if you choose to go this route.

Roslyn, Thank you for your compassion in this matter. You are right in that I am passionate in this as ,except for birthdays, Christmas,and the few times that I can make a 275 mile drive, it has kept me from seeing my 2 boys for, over 6 years. You are also right in that I should attempt to start an organization that deals with these type of situations. I have taken 2 and 3/4's years training in school for a job that they won't let me do. I had a vocational rehabilitation do a standard background check before I started in which nothing came up. There should be some kind of compensation for this and the FALSE mark it has given my name. Enough crying. Again thank you for your response.

Your need to consult with an attorney and find out what your best recourse is. Sueing is not always the best solution. You do however need legal representation to resolve these issues.
