Who has child custody in california if their is no court order?

Im pretty sure that with no court stuff involved and if it is just the father and mother who want custody it is up to them to decide but if it doesn't work out then that's when the court makes a decision. If this helps do me a favor and rate it would really help me out!

Typically Its 50/50, But the best idea is go to family court for custody and child support

My son's mother and I agreed for him to live with me gave me his birth certificate and all his important documents. I've enrolled him in school and cub scouts and 1 month later she is calling me back saying she want's him back. There is no court order or anything. Do I have the right to refuse him going back since each week he changes his mind what parent he wants to live with he's 10 yrs. old ??
