I received an email today saying the distribution of checks will be complete by the end of september and the average claimant will be getting 0- a few hundred dollars. Those were the exact words.

When I called,the person who answered the call was the person who told me checks would go out in September. She did not know how much. I don't know what the payout will be but I'm pretty sure it won't be close to what I paid in bogus charges.

I recieved an email from Sung regarding my settlement check and this was his reply:

Hi Mr _______ Please see below.

I heard back from the claim administrator, and the Disputed Fee amount for you is $10. It is possible that you have a lot of claims against Washington Mutual, but what our litigation captures is the $10 that Washington Mutual charged on your account. And, because it is a settlement (we didn't go all the way to trial), you will receive a portion of this amount in your check this month. I know this is a modest amount, but I hope this helps.

I received an email today stating there has been a delay in mailing. The courts have decided to look at the late submissions. So everything is being pushed back. I'm only getting a portion of $30. So at this point they can keep it. Ridiculous!!!!!

The distribution of the checks after the final decision was made was to begin immediately for the settlement proceeds to Claiming Class Members. The second circuit entered a summary order and judgment affirming the district court's final order which approved the settlement agreement. As of March 8th 2013, have yet to see any issued check. In addition, haven't received any response to e-mail addressed to case administrator (administrator@CasseseClassActionSettlement.com) as to status.
Patently obvious that, as is usually the case in class action suits, the attorneys are far more interested in their cut than restitution for the plaintiffs...

According to their website one objector has made a request called a petition for certiorari to take a further appeal to the United States Supreme Court. But it was denied on 04/28/13 and they still have not updated the website to when checks will go out. The settlement Company is the worst ever. I have tried to contact them several times in writing and thru email because my address changed and they do not respond at all. I have 2 other class action claims out and the settlement company for those claims answered me within 24 hours to update my address. This settlement company KCC is worthless.

I always hear back from Sung Lee from the attorney's office. (sometimes I have to send more than one email but I do always hear back) Last night I checked the status of the case (since the last info I had was that someone had protested the settlement) and saw that the Supreme Court had rejected the protest so I sent Sung Lee another email. Today I found an out of office reply. She is out until 07/11. As soon as I get a response I will post here and let you all know.

This is the worse settlement company every all this time they better get payments correctly. Settlement final in May and it takes 3 months to get checks out, RIGHT or they just capitalizing on the interest in the own accounts.

This is the most recent response I received from Sung Lee at the attorney's office. (she sent me the email on July 12)

We are currently processing to get the checks out. As you know, because the U.S. Supreme Court denied the petition, there are no more appeals left. Because of the volume of the people in the class, we think that it will take a couple of months to get the checks out still.

I recieved an email from sung-min Lee on july 26th
, he stated the distribution of checks would be completed by the end of september and they would most likely be between 0 and a few hundred dollars. Those were the exact words.

This is the email I just got today from Sung-My claim was $86,000.

Please be advised that we have your claim in the system and your “Disputed Fee” amount is $99. As a result of the settlement, you will receive a check for a portion (not all, because this is a settlement) of this amount by the end of September.

I have paid close attention to this since i was mailed the forms.. I had 3 loans with WAMU in the time frame mentioned. I am hopeful to see something soon from them. If anyone gets paid, please post here. It only takes 2 minutes to sign up on the site.

I have seen no money yet, I to had 3 loans with Washington Mutual. I have been in other Class Action Law Suits and the money was received right away, it never took this long.

Well, today is Sept, 26. I guess it was definitely estimated. Wonder if it will be worth that 2 plus year wait for this. Also wonder if they will update both their toll free number, and update their website to gives us another estimated date. Can't believe that it has taken them from April to process these checks. Thank goodness they don't write my paycheck. I'd be living on the street.

Well, we've been waiting patiently for 3 years and now we get to the "finish" line and nothing has been received. Between my husband and me, we put in 15 claims. So if anyone receives anything, please share. I would love to know what the payout is.

I just received this from Kurtzman Carson LLC today 09/27/2013 - It looks like the distribution has been pushed back to late December.

Counsel is officially filing for an extension on the distribution date - once we get the Court's approval we can/will update the website.

I sent an email earlier today to the administrator - Since there has been no Update regarding this extension may we all assume that the checks are in the mail as it is now October 2nd and no one has heard or received anything regarding this case?

Im wondering if this means there is more money than they are letting us know about....why would they file for an extension? What is the reason behind it? This has gone on far too long for them to request more time to distribute checks that are on average between $10.00 to a few hundred dollars. I was fully expecting $7,000.00 to $8,000.00 dollars for this. Keep emailing them and keep the pressure on them. This is out of hand now and we as class memebers have a right to know why this is happening and what is going on behind the scenes. Remember... they contacted us, not us them, to begin with.They accumulated millions of class memebers so they could line their pockets and ask for $13,000.000.00 This is bogus...unfair..and i suspect some sneaky stuff has been going on and now that the time has come to pay out and pay up, they are asking for more time...Very very suspicious if you ask me......

Since they're apparently screwing around with us (with the delays, amounts of our checks, etc) is there a next step that we can take above KCC Class Action Services? I'm not sure what state they're located in but if we find out, can we try to contact a state senator or SOME kind of political office there for assistance? This is beyond ridiculous.

Hi, Ms. Trump-Ludwig. The checks were supposed to go out in late September but the Court moved the distribution date because the Court wanted to obtain more information and decide what to do with claims that were filed late. As a result, the distribution has been delayed for another few months. Sorry to bring you bad news, but the Court ordered the date to be moved. I hope this helps.

They updated th ewebsite too - Currently there are no more appeals in this class action. However, due to several issues that have arisen related to the implementation of the settlement, the Court has extended the distribution deadline. The estimated distribution of the Settlement Funds is now set for late December of 2013.

I am considering putting in a complaint with the attorney generals office.I do think this is the best bet and this is a court order that was finalized!!!!!All claimants were to get 7500 each.The checks were to be mailed within 120 days after final decision!!!!!!

I was told that five hundred thousand filed, it doesnt make sense the amounts people are getting $10.00?. I spoke to J Tulsa he is one of the atty in the case and he told me that it was 50.00 per claim and some people could have up to three claims each. How much does this co KCC get? and the attys? I spoke to him about 2months ago and cant get any response now. This is just terrible and I hope someone is able to get some answers!

I do believe that someone cannot add correctly; because if there is 13 million dollars and less than 1 million filed where do they get the amount of $10.00. Because even if people filed more that one claim all claims would be considered in the 500 thousand claims. It doesn't make sense that amount not al all. whoever you spoke to has to be wrong. Even if everyone were to get the 7500 as stated by tlhisle that is only 3,750,000 looks like their math is off. The attorney General is the Answer but we have a Government crisis now keep your fingers crossed we get an answer real soon. they are collecting interest off our money because they are only allowed so much and want a bigger payout.

francokri, I agree it doesnt make sense how they are coming up with 10.00 payouts and when you look at the court documents at the bottom of the original (on the website) tusa and whalen did not agree on the amount they would be paid. I dont understand all of the legal wording but something is just so wrong!!

In regards to Stefanie2530 - they are so wrong in stating this to you as the Final judgement states that Late Filers are excluded. They cannot also ask for an extension if I read this correctly. " The distribution plan , as set forth in Article 6 of the settlement agreement, for the calculation and distribution of the claim payment to valid claiming class members is hereby approved as fair and reasonable, and the settlement administrator is directed to administer the settlement agreement in accordance with its terms and provisions. Upon or after effective date but in no event later than one hundred twenty (120) days following the effective date, the settlement administrator shall process the proof of claim forms and distribute claim payments to the claiming members in accordance with Article 6 of the settlement agreement. If any funds remain in the net settlement fund after two hunderd and forty (240) days following the initial mailing of the claim payments, then such remaining funds from the net settlement fund shall be returned to WMI"

I called KCC to find out if they have my name and I was told because the database was so large someone would get back with me in about 2-3 days. What sense does that make. If you have a database you can do a search on the name. I told her never mind.

Why would Lowey.com be involved in this, I do not see WAMU listed on their sight There are more than one lawsuit against WAMU each are different. Lowey is a defense team not sure where they come in on this. KCC is supposed to be the administrator Distributing the checks. I just filed my complaint with the Attorney Generals office!!!!!!!!!!I filed against Kurtzman-Carson LLC.They will look into it within 4 weeks.I will let everyone know when I hear anything :-)

We are still waiting for anything. Seems that this whole class action is a joke. Waiting almost three years and for what, nine dollars. I wonder if all these lawyers got their big bucks yet. I waiting for December to see if they change the date again.

Sung is very good at responding to emails. Just an FYI...I always put WASHINGTON MUTUAL SETTLEMENT (in caps) in the subject line of my emails to Sung. I don't know if that helps or not but I've always received a response from Sung.

Currently there are no more appeals in this class action. However, due to several issues that have arisen related to the implementation of the settlement, the Court has extended the distribution deadline. The estimated distribution of the Settlement Funds is now set for late December of 2013.

We are all expecting a check...pls post if you receive a check.

Ok, so what do we do when "late December" passes and we still don't receive our 8 dollars. I I have never seen a class action that has been like this. Over two and a half years, and for what. How could a class action be settled and not know how to distribute. You would think that would have been spelled out in the agreement. Oh well, we will just have to wait longer and see.

If I read the other posts correctly, some people were told the checks would be for $7500...and now we've suddenly plunged to $8.00 with a 3+ month delay on those checks??? How are they able to get away with this nonsense?

I sent an Email to Sung Min Lee yesterday asking if they had my file and also asked as to when I am getting my check and how much. Below is his response.

He said

Lets hope they have to pay interest on this as I am sure they are colloecting interest. I did see that the judge ordered them to pay us on 09/03. But have not receiveid anything yet. This is very frustrating.

Didn't one of the class member consulted with their Attorney General's office so that they can keep a watchful eye one these folks. I recalled how on a investigative show how the lawyers in the Phen- Phen case how they got mansions, luxury cars, and horse farms from that settlement.

I see that settlement checks will go out "late December of 2013". I've been watching this case for a long long time and have read the documents, but can't quite figure out what kind of money we'll be getting? Are we talking $50 or $500 or $5,000. I know its all a percentage calculation, but I'm really curious because of all the hoop-la. Thank you.

Whooo Hooo, Three and half years and more of waiting, and we are getting just about $2 for every year we have waited. If we wait longer it will be less than 2 dollars. Wow. This is nonsense.

From what I've read, there are approximately 500,000 claiments in this case. There is $13,000,000.00 up for grabs. We know that the lawyers always get theirs first, probably close to half. The initiators of the suit then get theirs. We get whats left. So now there is about half of the $13,000,000 available, $7,500,000. Divide this by 500,000 and you can see that there ain't much to go around. If we are lucky we might get enough to buy 1 gallon of gas.

I read in the court settlement that the attorneys are to get $3,900.millions what happens to the remaining 9millions it certainly does not add up to $10.00. WE NEED TO GET JUSTIFICATION/ JUSTICE.

The checks will be mailed on Dec 27th the amount is between 50 to 130 $ I payed 2 points
penalties when I refinanced , the total of 7200 $ and I will get the most is 130 $, that 's another scam by itself

I would think California because that is where the settlement administrator is located. We waited a long time for this settlement, and now we will just have to wait to receive our checks. I am curious as to what the check amount will be. If anyone receives a check please let us know. I would assume that it will probably take at least a week before anyone sees anything.

I believe there are roughly 500,000 class members. There is approximately $9,000,000.left after the lawyers get theirs to split up among the members. As you can see there is not much left to go around. I have 2 claims amd i'm waiting to see what I get. I hope it's enough for a tank of gas.

Does anyone know if the payments received are for an individual claim or cover multiple claims if you filed more than one? I filed 2 claims. Received one check which references one of the claim numbers. Wondering if I have another check coming for the other claim. Received a whole $33.54. Lunch for me and my wife.

This is crazy. I received my check yesterday, andI went to get a magnifier wasn't sure I was seeing right. The magnifier didn't help it was the same amount. These checks should have more numbers in them. Where did all the settlement money go? Why were we not refunded what we paid for these fees. Did you read the letter that came with the check. If checks aren't cashed by March the checks will be voided. And then what happens.

Received my check yesterday, $12.99. I think I only refinanced one loan with WaMu during the class period. Court documents say the settlement was $13 million, of which $1.7 million went to the attorneys. Percentage wise that is actually pretty low, usually they get 25-40%. With > 500k claimants there just isn't much to go around.

Wow, everyone has gotten such a paltry amount. I also live in NY and am waiting for my check. Mr. Lee emailed me a few months ago and said I was getting a portion of $29. I got more money than that for the Sketchers Class Action lawsuit. I got $108 for the Sketcher's suit and even got to keep the sneakers which I still wear.

Just got my check...$24.79. Interesting that the letter claims this is the amount I informed them that I had overpaid. That isn't even CLOSE to the amount I gave them that I overpaid.

cjcalopez09, I submitted two individual claims each with a different claim number. Both were submitted at the same time. I would think that you should receive a payment for each claim you submitted. If you had 7 different refis you should have had 7 different claim numbers. I would think you should receive 7 checks, unless it's noted on each payment that multiple claims are paid. Good luck.

Ariel1, I called the 310-823-9000 number and spoke to someone named Arlene and she said what you said. I should had received 7 checks, one for each claim. She said that they should have arrived at the same time. "That's not good."
She will need to check the database and then she have someone call me back in a couple of days.

After speaking to someone there, she tells me that I should have received 5 checks for 5 claims I submitted. The administrator supposedly checked the claims and said that they are all the same claim and that is why I only got one check. That's not true. Why would I fax over the same claim 5 times in the same transmission.
I told her I want a copy of what I sent them. She said they need a week to do that. In the meantime I am looking for my copies, somewhere around the house. This is crazy. I am thinking that they are in so much control that they can decide to pay us whatever they want. Not good!!!!

Well, they found the 5 claims I submitted and they tell me that the reason I received 1 check was that they consolidated the checks into 1 big $30.60 check.
Arlene tells me that the checks varied between pennies to $100.
There is nothing else I can hope for anymore. Good luck to everybody. That's it, I am done.

I tore my check up on accident. I was able to retrieve the corner of the check with Bank of America, the amount and check#. I have called BOA and they told me a new check needs to be issued from the payer. I have called the usual 877# a few times and visit the website but have no real way of getting in contact with anyone from the administrators office. Anyone have any suggestions? My check was for $15.09, I knew nothing about this lawsuit until my mom called me and told me there was a check mailed to her address.
