1.5 year paycheck. bank says employer still owes money regardless if expired. employer refuses. can i win this case in court?

Same thing happened to me. I just ended up throwing the check away. Probably depends if it's alot of money and worth pursuing. Do you have prepaid legal? It's not much to be a part of and you get help from an attorney.

Yeah..mine was like 100. Well, it is a lot but could be costly to go through lawyers. You could get on with prepaid legal.

If the bank says the check is good and the employer admits to writing the check I would say you have a good case....but ask a lawyer. Might check with state labor board and explain it to them....they might help ?

You might have to file in small claims court and that is no guarantee. I know this doesn't help now but next time file a police report and one with the bank for a lost check that way you have ' proof ' of it being lost. Must be abuncha jerks and greedy basturds if they wouldn't cancel the one check and issue another one. And most checks are limited to a one year limit so legally they are right. Small claims court the judge has some leeway tho....not the same as criminal with regards to proof and intent. Do you have any ' proof ' you went to company and talked to them about check ? That, and anything else, like witnesses that the company has a habit of shortchanging other employes, would be in your favor....got to decide if it is worth it to you.

Here is an idea....cash the check when you get them, don't let them expire!

Well i lost the check days after i got it in moving boxes. when i asked to get a new check they said i needed proof?...so a year and a half later i found it and they still don't want to pay.

You can take them to small claims court but they can refuse to pay you even if you win. I guess you can check with your state labor board to see if this is an area they can help you with.

ya for sure, after the drama they caused with one simple question of me getting a signature to renew this check, i am hoping i don't have to fight this.

A check more than 6 months old is no good, so the bank will not honor it. I don't understand why you have a check that's a year and a half old. Assuming you mislaid it, you have a claim for payment that was not made. Because of the small amount, small claims court is your best bet.
