Having a lawyer may be advantageous but it doesn't give you a greater chance at getting custody. Most custody cases nowadays end up in divided custody.
I think it depends on both of your living situations. That is what a judge is going to look at when they decide custody.
That is a better question for your lawyer. But mostly it depends on what state your in.
It's an advantage but know that unless you can prove she is an unfit parent most judges are for the mother
