What do I do if a dealership sold my pre-owned car?

I pre-ordered the new 2013 Ford Fusion Hybrid with all of the features, but I think the dealership sold my car to someone offering more than MSRP as the car is in very high demand. Is there any legal action I can take?
I have already laid down a $1000 deposit, and in exchange, I got the window sticker, the VIN number for the car, and a delivery date.

I am suspicious that they sold the car because the manager told me I would have the car on the 17th of December, but there were lots of delays due to exploding 1.6 liter models (mine is 2.0L), but he confirmed the car was in Phoenix, AZ almost two weeks ago.

Get a lawyer and press charges. Sue them, then sell your car, then combine the money together to get a new car mate. Wish ya' the best of luck and I will pray for ya' mate. And thank you CCFrenchie, I forgot to say that you should re-read the contract throughly for anything about this topic.

Since you are going up against a car dealership, I would advise you to hire a lawyer. You did put down a deposit, and received a VIN number. At least consult with a professional lawyer to see if you have a case!

If the car was preordered then shouldn't it be yours? I don't think they had the right to sell it.

i think they sold it to someone else because that person offered more than MSRP. you're correct, that I signed a contract proclaiming that "i had the first right of refusal to the vehicle"

First go over your contract and read all the fine print. Then look into getting a good lawyer that specializes in this area. Chances are that you are not the only person this dealership has done this to

You said you( think). So be 100% they did sell it to someone else. Then just ask a lawyer if you have a case

well in some cases the car or model requested sometimes are hard to get a hold of. some cars have to be traded between dealerships called dealer to dealer trade. and not all dealerships are the same. some are given higher priority due to sales volume and the bigger issue the customer ratings. if one dealership has a lower cust rating than another and both ask for the same car the manufacturer will give it the higher rated dealer. to me it sounds like the saleperson overpromised time and delivery start calling other dealers in and out of area because all want to sell now. and if one dealer gives you the run around. you get to run around to other dealers. and if your dealership is one the lower rated places bacause there salespeople make this mistake often. you could be waiting a long time. the other thing the may not have anyone to get it from phoenix to you. this was common issue in dealer trades.
