As you may have heard apple is now selling the iPhone 3GS for free with a two year contract, if I get that and ask to activate it at home

and then take out the sim card before activating it so it does not activate the 3G services and have a free iPod with camera and continue to not use the 3G services would that go against the contract or would I like not be aloud to do that? if anybody knows I'd love a semi reasonable answer

Doing what you have described above would be going against the contract with Apple. The iPhone 3GS contract is designed to enable a buyer to own an iPhone by paying for it over a period of time as specified in the contract.
