my son was taken from me from the state of mt when i was visiting from ca and only here for two weeks can they do that if he was in no harm

my son was kiddnapped by his father for two weeks while we were visiting mt from ca

Details, details, details. Are you originally from Montana? Was your divorce decree from Montana? Is there issue with who is supposed to have custody? Does California say it is you and Montana says your ex? Your wording is confusing to me.

The father has the right to visit and take his child. However, if this was not arranged, then he does not have the right to take your son. Depending on the child's age and your cause of separation from the father (in case you are), then you can choose to press charges on the father.

WOW you will need to contact the CA court and have the order sent to MN a judge will have to hear the argument of abuse you will need a good attorny in BOTH states.Do you have perm custody? has CA ever chared you w/ abuse? that is a good indicator of what will come out.
If you do win/ get him back file charges in MN for kidnapping unlawfull restraint /imprisonment visitation violations any charge no matter how small. have the CA judge denie ALL visitation.
Unless you are at fault. then u'r get what you deserve.
Personaly you both need to grow up and do what's best for the child NO matter what.
