Does the ADA cover a parent's absences within the first year? FMLA doesn't and we don't know what to do...

I have missed a lot of work because my daughter has an auto-immune disorder. My employer, Wal-Mart, wants to fire me because of this. I can get documentation from her doctor to prove her illness. Also, she gets SSI for her disability. FMLA states I have to work there for one year before I am covered, so I was wondering if the ADA would. Thanks for your help!

ADA doesn't cover a parent's absences within the first year. According to ADA's reasonable accommodation obligation, an employer is not to give an employee time off to care for a spouse. The best thing to do is to contact your local labor offices for more details.

I don't believe that your daughter's disability gives you any rights under the ADA, since that law is intended to accommodate disabilities of the worker, not her family. Walmart has a horrible reputation, you're better off finding a job with an employer who doesn't treat its employees like dirt.
