Sallie Mae Offset My Income Taxes. What can I do>

Sallie Mae took my income tax refund today although they acknowledge that my student loan is out of default. but because I filed my taxes before they removed the offset from Treasury (which I had no idea was there). they're still getting the money and refuse to refund it. They said it would just be applied to the remaining balance of the loan although I'm on a consistent payment plan. Is this legal? Can something be done about this?

It is not legal for Sallie Mae to interfere with your tax refunds. This is just like a credit card company is not allowed to interfere with your taxes. They should first sue you to enforce the debt and then probably garnish your wages. The best thing to do is to find a consumer attorney at NACA or National Association of Consumer Advocates for assistance.
