My sons father used him as a dependent without my permission can I still carry him on my tax return

I filled out an identity affidavit but I am afraid he carried my son already. Will it affect me in my tax return

Only one person can claim the child, so if he did, then you can not.

Carrying of one dependent by two people is not allowed. Both you and your son's father need to provide proof of your right to claim your son to the IRS. If your son stays with you for more than half a year, then he ought to be your dependent.
