Can child decide to live with grandmother without grandmother getting custody or guardianship of minor child when unmarried father is dead?

Unmarried father without custody of minor child dies and leaves everything to minor child with paternal grandmother executor of will and estate of minor child. Minor child lives with her mother now.

No ... the child can't decide.
Though, in some states, the child may petition the court to change who has custody - and the judge may take that into consideration.

I didn't think so, no such law in Ohio. But I also wanted to know if the paternal grandmother had to go to court to get custody of the minor child, because her son was not married to the mother of the child, and the mother has the custody of the child.

yes they can decide the judge will ask the child who he want to stay with it the child decision

That is actually rarely done by a judge anymore. It makes it to controversial and too much pressure on the child.

Yes they can decide, the judge may ask the child with whom do you want to live with? the you have your answer.
