My girlfriend is pregnant but we are both still married and separated for a year. Can we be a common law partner?

No. You can't be. You are still legally married to someone else. Some states don't recognize common law anyway.

I dont fully understand your question. If you re married to other people and divorced each other, I recomend shared custody. If you re married but far from each other, then Idk.

We are both still married but has been separated with our partners for a year. Now she's pregnant and I am wondering if we can apply for common law though we are still married? She got married in her country not here in Canada. Thanks

If you are legally married according to your federal laws but separated, then you can still apply for the common law marriage. However, this will depend on your agreement as the common marriage has a limited number of jurisdiction and they are not fully recognized as marriage. You can talk to your attorney for advice.

Are you married to each other? Or to other people? If you are married to each other you are married till you are divorced, separated or not separated means you are legally apart but legally married if you break the separation you are still legally married.
