let me clarify, the phone was smashed on front and back and they gave me a new one. I asked what i should do with the old one and they said it was no use to them. they did not want to repair it. So it just sat in my drawer and then when i left the company i ended up packing it up with my stuff. I would hate to think this is theft.

Ummm...i think thats called THEFT!!! You should have returned it whether they asked for it or not. They could actually prosecute you for theft because you kept it instead of returning it. Mail it back ASAP!!
