The debris from a car I was in an accident with is on my side of the road, does this indicate it was his fault? He claimed it was mine.

I was going uphill about 7mph, he was speeding downhill. There were no lanes marked and it was a residential area with cars parked on both sides of the road. He claimed to the insurance company it was my fault, there were no witnesses, I was ticketed for being in the wrong lane although the cop wasn't present and didn't even ask me what happened. The cop was also very rude although I am a friendly and polite 19-year-old girl. ...I managed to convince the insurance company that I am only 50% liable but would like to show he was at fault, do the pictures showing the trail of debris prove this? I also plan to invalidate the ticket in court - the county it occurred in is known for law officer corruption. (Williamson County in Texas)

similar scenario happened to my little sister. She went to do a legal u turn and a woman went to go around her on a double yellow and tboned my sister. Even though the woman flat out told the cop, " i only looked at my cell phone a second" my sister was found 100% at fault. Your a female in the 16-24 year old bracket. I would call a couple of lawyers. Many will do free phone consultations!

It is likely that you could have been at fault. Nonetheless, I would recommend that you have the case evaluated to determine the true cause. talk to another cop or a lawyer.

you were going up, you had the right of way. talk to a policeman. they will help you.

Sounds like he might have been going too fast to respond to what was on the other side of the hill. Talk to a lawyer ASAP! The police report is only the beginning of the process. They don't investigate much anymore! Been where you are and won.

Sometimes a police report is written. Check to see if he did that

I believe he wrote an accident report, but I also think he questioned the other driver as to what happened but definitely did not question me.
