If the custodial parent is laying the hospital brain dead due to drug overdose does the child go to the non custodial parent

There are reasons why the non-custodial parent does not share custody. This will have to be looked at by Family and Children's Service because the child's welfare is the primary concern. This poor child has one parent brain dead from a drug overdose and the other parent did not share custody. I hope there are grandparents standing by.

The mom won temporary custody until divorce court the child was in dads care since mom went into the hospital and 4 days later dhs seized hus daughter and 2 1/2 yr old grand daughter and put them in seperatw foster homes. What can we do to get them back? Dhs called said they needed to physically see the kids to make sure they were ok since someone turned the mom in for neglect. But instead they placed them in foster homes

When dad fought for custody moms new bf her attorney and the judge are all masons. He didnt have a prayers chance of getting custody. Si now what can we do to get the girls back?

If the non-custodial parent has a history of negligence, the child could go to one of the grand parents.

if the custodial patent is brain dead the other parent have full rights to that child custodial parent means that the kids live with them but you as the other parent is just as involved with the kids however there family members may try to fight it

The daughter was in dads care since mom is brain dead in the hospital and 4 days later dhs seized the daughter and grand daughter and put them in separate foster homes. Mom won temporary custody until divorce court. Dad didnt have a fighting chance of getting custody since moms new bf,her attorney and the are all masons. Which to me would be a conflict of interest for the judge
