If you're still making payments then technically it's not your car.
It's perfectly legal for them to track their own car.

if the person is still making payments then the car belongs to the bank not the dealership

Ever hear of General Motors "on star" system. Most people don't know it, if the system is in the car it's is tracking you. Even if you don't subscribe to the service. Miss two payments and the car shuts itself off and reports the location to GMAC financing to make it easier for the repo division to pick it up! Have a major accident and the first thing the cops seize is the cars computer. It will tell them more about you that you're momma knows!

Some dealers also put on devices that will not allow your car to start if you owe them money. In Washington state those type of lots are considered shady. Pay extra and buy from a dealer with a reputation.
