No contract papers for the rental property

I didn't make contract papers with tenant who decided to stay last Aug after one year contract from 2011. Now she decided to leave. Do I lose the deposit made from previous contract? Ordinary rent is $350, but she is paying $290 because of the previous contract was one year contract. We will lose a lot of money because the property is for the college students, it's almost impossible to find somebody for the rest of the school year in this time of the year.

Since the original contract expired and it wasn't renewed, I'm afraid there really isn't anything much you can do. You will have to refund the deposit, although you should talk to an attorney about this for legal advice; you might have a remedy since she made an oral contract.

Am I wrong in my understanding that once a lease runs out and a tenant stays, they are then on a month to month based on the lease deal to begin with, as in an implied contract? I would think the deposit would not be repaid unless enough notice was given and there is no damage to the unit.
