Why is gay marriage still banned?

seriously. section 1 of the 14th amendment states, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." Depriving homosexuals of the right to vote is a violation of amendment 14. and the first amendment states "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof"

That is the question that is more or less before the Supreme Court as we speak. Hopefully they will do the right thing and give everyone marriage rights equally.

At the SCOTUS hearings, Scalia asked "You say it is unconstitutional to deny gay marriage. So, when was it made unconstitutional? Was it at the beginning, or the 14th amendment, or some other time?"
Justice Kennedy does not want to go into uncharted waters. It looks like the decision may be to be returned based on standing. It appears they want to narrow the issue, so that it will either be returned to lower courts, left to stand or look for a limiting principle. It won't be a broad ruling: the constitutionality of gay marriage will likely not be forced, it's likely going back to legislatures. This allows for compromise and accommodation. It's likely the right decision, on balance, as it avoids the roiling that something like abortion has been in America.

@Shiney: While you are correct that it will be less contentious (for heterosexuals) if courts leave it up to the states, it bugs the dickens out of me to leave what I see as a civil right up to the tyranny of the majority. But I think you are right. Prop 8 will probably be struck down either because of lack of standing by the pro-Prop 8 faction, and/or because it can be argued that the right to marriage was taken away after it was given. That keeps the ruling out of the jurisdiction of other states. I have no idea what they will do with DOMA. What are your thoughts?

Money-married partners of homosexuals would be able to file joint tax returns, receive social security benefits from a deceased partner, and share in health benefits. They won't do it because it costs too much!

Our founders did not believe that. They believed our rights came from God and a country without God was doomed to fail. This seperation of church and state is a statement made in a letter that was referring to keeping the government out of the church business, not the other way around.

Why can't each state, city, or town vote on yes or no to gay marriage. Let the people decide. Is it really that hard to figure out an answer to this question. After all, we do pay for our government politicians and Judges. And they can't seem to figure out a budget for the country ,so how can they possibly solve the gay marriage crisis!!! Personnally we've given the government too much power in this country and now were all paying for it.....

Someday we will all be "old" . Then we will learn how wrong we are about some current topic from those younger and much wiser than we are.

There are many young people who believe what the Bible teaches us. Old people have a long life of experiences to help in making any decision. For example, I was a hippy in my younger years. As I lived my life I began to realize how our motto of "Sex, Drugs and Rock and Roll" had damage many people's lifes, which was never the intentions we hippy's had. We just wanted to have fun. We did not want to have our parents life of work, home, and traditional family. We were all family. But after a while of communal living we found our new families to be lazy, druggies, and and truely low lifes that we never could have imagined. There were children running around dirty and imitating the disgusting habits of their many parents in the commune that caused behavior problems in these kids and I believe brain damage from parents using drugs around them and during pregancy.
My point is that "getting with the times" as you say, isn't a true test of something being good for society. Years of tradition is. We all can learn much from our elders. I am old and still think quite often what my parents would have done in some situations that I go through and their advice still rings true today. Advice I am sure they got from their parents and so on through history.

Being stuck in your ways is OK if they're tried and true. When you are older you have seen many times that change should be looked upon with some skepticism . That's just being "older and wiser" vs "young and foolish".

It is a persons right to choose their partner,same sex or not but wether you believe in god or not or even the idea that we should except change marriage from the beginning was always established and meant for a man and a woman. It's in the bible, thus Adam and Eve!! But like I said if you believe in God and his word than you should be against the marriage part of gay people. If you don't believe than your for it. That's what's wonderful about the freedom of choice, it covers every part of our lives

To shay... I never judge I just give my opinion. I stand corrected and do whole heartedly agree with your replies. We have gay people who attend our church. Just like I have learned its not possible to stand for one side of a topic or belief without respecting the other side. I love everyone and all people and in the end we are all entitled to our individual beliefs and opinions without being hateful or hurtful. Thank you for helping me think more openly about this topic. Curiousity, as a Christian, we are all sinners so I am not here to judge you. But God teaches us that to condone sin - is to sin. And to love the sinner but hate the sin. He doesn't want us to be okay with sin as long as we don't do it. He wants us to guide others out of the darkness and into the light and not just say "oh well, it's not my business if you stay in the dark. I will just enjoy the light and you can enjoy your darkness"

I think it is because of ignorance and intolerance. Gays and Bisexuals should have the same right to marry a same sex partner. Most Christians are against it because of outdated beliefs, and in fact I think that applies to most people. Some are just too old fashioned and need to get with the times, and need to learn something called tolerance.

We used to spank our kids. Later they thanked us. Now we will get severely chastised for it , if not worse. When we eat out now you can observe screaming kids climbing all over the place while parents sit idly by. Questionably better outcomes.

Alcohol, something that kills and ruins people on an hourly basis, used to be banned as well. Granted two different things. But now alcohol is legal. EVEN though there is nothing good to come out of it.
Gay marriage, hurts NO-ONE. They are allowed to show the love of their partner in front of the world. WHAT is so wrong with that?

Alcohol was not tradititionally banned throughout history. In fact it was a very short time of it being banned that we realized it was hopeless to do so and the law was changed back to it being legal. That is not the same thing going on with gay marriage. It has never historicaly been allowed in most of the world.

One of the big problems has been politicians' fear of pulpit backlash.

The churches, because of their ability to influence congregations, hold a great deal of political power. They can vote politicians into office, or drag them down. Since politicians are vote-orientated, it would be a brave congressman or political party that stood up to such opposition.

Hopefully, if the Supreme Court rules in favour of same sex marriage the politicians will be able to let out a collective sigh and say, "Well it wasn't our fault. That's the law now."

It's a big issue in Australia as well as the US and is under consideration here at the moment. Our churches are not as influential as yours but they still wield a great deal of political pressure.

Honestly, I just wanted to see what everyone would say. My standpoint on it is that, as the scriptures say, marriage is between a man and a women. The purpose is to have and raise children, which can not happen with same sex marriages. I do not believe they should be discriminated, and yes they should have equal rights.

Because it doesn't benefit society and many people feel that it has always been a union between a man and a woman since the beginning of time. Also because many people believe in God and just because society's views change, He doesn't.
This doesn't mean they want gays to not have equal rights. Many believe a civil union is fine and ALL rights that they go along with that. I would personally be happy if they (the government) would start treating every citizen equal. Starting with the IRS. No special tax breaks for anybody and everybody pay a fair percentage of their income in the form of taxes.
Would gays be fighting this if they had all the rights a married couple have? Why don't they have these rights right now? And why would this not stop this whole marriage thing? IMO its nothing to do with marriage or rights. It's "here I am. I'm not hiding anymore. I'm going to make you deal with my gayness because you made me hide it. I don't care if your religion says its a sin. Watch me sin and explain it somehow to your children why God doesn't like behaviors like that but even my teacher is gay and he's nice." Like I said its not marriage they want. It's in your face so lets be loud and proud that we are odd.

Ideas and traditions are bound to evolve with the thinking of man. That being said, I certainly hope certain people can suck it up and accept others. It's not just marriage for the sake of getting married, many other rights come with that. And it's a stronger connection than 'my girlfriend' or 'my boyfriend,' they're your partner for life. About 1% of the total number of currently-married or registered same-sex couples get divorced each year, in comparison to about 2% of the total number of married straight couples. Note that the percentage of couples that get divorced eventually is close to 50%, but only 1% or 2% of them get divorced in any particular year.

All the statistics in the world will not make the anus meant for the insertion of the male genitalia. That is the bottom line. Yes, ideas and traditions evolve as with the thinking of man. Because some people can't stand the idea of someone falling in love with the same gender. I think it should be legalized, but many other people disagree, so that is why it is banned in some places still.

You can own a car if you are blind. You can ride in it and enjoy it's many features. You can run your hands over it's surfaces or just sit in it if you want to and breath in that new car smell. You can simply love that car. Although you have your name on the registration you still cannot get a drivers license to drive the car.
With a same sex love of your life you can live with each other and enjoy yourselves in every conceivable way but you can't get a marriage license.
That's the way it's always been and that's how it should remain. Religious beliefs are merely a side issue.
Isn't it entirely possible that wives being women and husbands being men & not the other way around is after all best for mankind?

Lots of things that need to be triggered by marriage, like tax benefits, inheritance rights, ownership rights, visitation/medical decision rights, too many to mention. Why shouldn't same sex marriage be allowed so two consenting adults that love each other have the same rights that heterosexuals have in our society?

Koichan, I'm not knowledgeable on these many points , however naming your property under a trust is simple and a will to include any overlooked assets should cover much of this. Many married people have these in place, and wisely so. I know tax change is slow in coming but I can foresee the marriage benefit disappearing in reforms coming.

The point they have tried to make would be that what they do should be considered normal and unperverted. And beleive me, this is my own opinion. Everyone elses opinion is that gay acts are natural and babies are born gay.

Because most people despite what they say - know that our laws are basically founded on the commandment that God has in place. -Thy shall not steal, commit adultery, murder, and etc. Also the Bible clearly speaks against "man who lay with man and women who use their bodies for unnatural purposes 1 Corinthians 6:9,10 "What! Do YOU not know that unrighteous persons will not inherit God’s kingdom? Do not be misled. Neither fornicators, nor idolaters, nor adulterers, nor men kept for unnatural purposes, nor men who lie with men, 10?nor thieves, nor greedy persons, nor drunkards, nor revilers, nor extortioners will inherit God’s kingdom."

So, even though most people may not be religious it is just in the core of our being to know that same-sex marriage was not introduced by God.

However, Almighty God has given mankind "free-will" to choose to do what they want to do with their life. However, we are all accountable and can not force our ways on anyone because we all have the opportunity to review and analyze those things written aforetime for our benefit. (2 Timothy 3:16)

Then perhaps we should not allow adulterers to get married and enjoy those benefits. Or how about we start cutting off the hands of thieves. Maybe we should make everyone whose right hand offends them cut it off. laws are just words. usually people are stupid, some want to hear about equality and human rights, but mostly its just a bunch of words to calm them down, and most of them want to hear about their stupid ignorant belifes: were here in the 21th century and still most people belive in gods, racist-fascist rights, they are still act like animals, ant it was the same 2000 and 4000 years ago...

Gay marriage is not "banned" in this country. A few states do allow it. And the federal government needs to stay the hell out of it, as it is not it's job to decide the issue for the entire nation. State sovereignty is being constantly threatened by the federal government which has no lawful right to intervene with state laws. The majority of Californians have voted "twice" against gay marriage. And it is not supposed to be the job of any court to overrule the decision of the majority of "the people". Throughout the US, gays and lesbians
are entitled to form a "legal bond" that entitles them to the the same rights as any other individuals who choose to do so - and they know it. They don't really want "equal" rights - they want "special" rights - the right to change the definition of a word that has always described the union between a man and a woman. Maybe they can be ever so much more "special" by finding a word of their own. "Marriage" doesn't cut it!
