How long does it have to before you to use a song that you did not right to make money or copy without getting in trouble?

I have a great Idea I just need to know if it is legal to use music like Dean Martin I mean do they have to be dead for you to be able to use their music is there a time limit on trade marks on songs?

The copyright expires 70 years after the death of the original copyright holder. This is different for works for hire. You'll have to look that up if you need that information.

Trademarks are separate than copyright although a work of art could be a trademark and protected by copyright.

The author of the song has to have been dead for about 75 years.

It's over 100 years! If they're deceased, their heirs hold the copyright & get the money! I think the others are right with the 75 years after death!
