Is it illegal for a owner to give another person a car as a gift, then after its said and done...the owner wants the $$ for it months later?

but after the car was given, the previous owner still had the car in his name, which never had been switched....and told the new owner to sell it if he wanted.....and it has been over a year....then the new owner that was given the car decides to sell it, again a year later....but still the old owner is trying to obtain the money relieved for the car....

If they gave you the car, but not the title, the car was a LOAN and not a gift. Sadly, this is how many courts will view this transaction also.

It is illegal to give out a car as a gift then ask for money after some time. The ownership of the car should have been changed and the car registered under the new owner's name. If registration was done, this kind of situation would not have appeared.

The new owner cannot sell the car if he doesn't have the title.

rustyboilerz and Harleyuki are both correct: this was not a gift, it was a loan, since the owner kept the title. YOu can't sell a car unless you hold the title. You don't have to pay for the car if you return it, but if you keep it and want the title the owner has the right to ask for money. I tis not "illegal" to ask for money for the car, but this situation has to be corrected - either return the car or pay for it and get the title, Keeping the car against the wishes of the owner is theft.
