Prior to a divorce, my sister got ownership of husband's insurance policy, and remained the beneficiary. In Fl. Her ex recently passed.

Can my sister still receive the proceeds now that her ex has passed away.

As long as she is the beneficiary, then yes.

In theory yes. Unless he changed it later or re-married. A new wife might have claim depending on the paperwork.

Fl has passed a law regarding beneficiaries of exes, however she also owns the policy. He gave her ownership before they divorced, so we are hoping she is still eligable. Otherwise, his estate gets it, and they have already gotten all the stuff he took when they divorced.

Does the estate know it exists? You may want to check with a lawyer on this one.

It is not a part of the estate, ownership was transferred before the divorce, and the divorce stipulated that what he took with him was what he got.

seems it would be clear if it was moved before they divorced. i would guess it cannot be claimed as part of his estate. check with a lawyer.

Well, hopefully not. They were divorced, so she didn't lose an income when he died. Women shouldn't bleed men dry.

He spent all the child support, ran them into debt and used the college funds for the 3 sons. It is a small policy. Generalities are pointless.

Same thing happened to my step mom..Her ex never took her off either..She was awarded the sum.

no, but he had spent alot of the stepkids money so he wanted her to have it if she kept paying premiums.

If she is the beneficiary on this policy, it is hers (unless a court ordered otherwise).
