Is medical marijuana legal in Texas?

Report as

This is how it works.
In some states it is legal for medical use
Federally, it is still illegal due to Federal laws.

So no matter how many states have it legal for medical use, until the Federal law changes, it is still illegal. State laws cannot contradict Federal laws. A Federal law always overrides any State law.

At this time, medical marijuana is not legal in Texas

For medical purposes yes. It's only legal for the public to buy in Washington state and Colorado.

Keep in mind that on a Federal level, it is illegal regardless of if you have a prescription or not. As to Texas specifically, they do not have any provisions for medical marijuana, it's still all illegal there. You can get details on penalties, etc... from the following...

Medical marijuana is not legal in Texas, sense they passed a bill stating that any person under the age of 21 caught with a small amount of pot will not be arrested, people have been making up rumors that medical marijuana will soon be legal, but in all likeliness based on past events, Texas will probably be the last state to legalize the medicinal use of marijuana.

In theory, Texas law enforcement officers have the option of ticketing offenders in possession of less than 4 ounces (class B misdemeanor) instead of arresting. In practice, however, Travis County (Austin) is one of the few counties that opts for this (Harris County policy follows similar suit). Most cases get dismissed in Travis County after paying a fine, providing community service, or taking drug classes, depending on such factors as the details surrounding the arrest and the offender's criminal history.

In most places, such as College Station, officers will arrest offenders for any amount of marijuana whatsoever.

Marijuana which is legalized in any state and in fact DOES trump any federal law according to our 10th Amendment in the Constitution.
