If the father doesn't sign the child's birth certificate when the baby is born does be have parental rights? If so, can they be terminated?

my best friend is going thru HELL and we need help as soon as possible!!

Regardless of if he signs or not, if he can prove that the child is his, then he has rights. The only way to have them terminated would be to prove that he was somehow a danger to the child, or an unfit parent. She'll need a good lawyer.

It's not just about the rights of him or your friend . You can't be selfish you have to take the child's feeling and life into consideration do you realize how harmful it can be for a child to grow up without a father or not see him it's damaging . The kid will grow up not knowing and wondering who the father is while all his/her friends talk about there mom and dad . How do I know this I had to grow up without a father a large portion of my life and it hurt please don't do the same to this innocent child .

Well if he cares, why didn't he sign them from the start?you can't be a parent when YOU FEEL LIKE IT.You should own up to your responsibilities from day one.And HE OBVIOUSLY HASN'T.And maybe it's better to grow up without a father sometimes than get to know one who is full of it.where is he now?why wasn't he there from the start?why didn't he sign?

I know it's horrible for a child to grow up with the absence of a parent and obviously u know first hand and u know how much it hurts but, when a child's life begins with so much turmoil and trouble maybe it's for the best.It will only get hurt in the long run, knowing that one parent didn't care enough to do the right thing.I don't know any mother who for no reason other than to protect her child, will deliberately deprive her child his father.I'm sorry u hurt during your childhood.Sadly though today it's very common for children to grow up with one parent.I know...............

I went through exactly the same thing with my friend. The court didn't recognize his parental rights and he was denied visitation rights to his child. It wasn't that hard to achieve. What we all proved is everything I just said to Shane. He didn't care to sign the birth certificate from the start and neglected it.He wasn't there for the child from the beginning and that was enough for the judge. After 5 long years my friend decided to give him access, even though he didn't deserve it.If the father doesn't sign the birth certificate, you can name anyone u want as a father. As long as the other person knows of course.Hek you can put ELVIS as the father. This however, was in my country Australia. But I have some lawyer friends from the Us and I will ask them.I'm sure it's pretty much the same.Take care,I know how you feel but,you need to be calm.
