Can You Be Arrested For Being Under The influence Of Marijuana?

Okay If You Get Caught with it i know you will get charged for it. My Big Brother told me the idiotic story about how they threw a party like project ex and got arrested because of maryjane. He says they already smoked it and were just riding off their high but they got arrested. Where I'm From Pennsylvania, the cops don't arrest one for being high..... I'm wildly confused?????????

They can't unless you admit to being high. There's no proof otherwise.

You have to be in possession. Technically you can get in trouble for being intoxicated in public or DUI if your driving. But there is NO way to prove a person is currently high on marijuana, and no way to level how high they are. You would have to admit to smoking or the police officer would have to see you smoking, and if they saw you then you would have to be in possession. Being high, is not against the law

There us a way... Either by a urinalysis which would indicate "THC" in the body or a blood test which would indicate same. Enjoy your day.

From my experience, it's rare someone would get arrested just from being high on marijuana because a lot of labs don't normally test for THC or it's not worth the expense and most prosecution involving being high on marijuana are associated with other things like being intoxicated in public, disturbing the peace, impaired driving, etc.

Law Enforcement tests for THC as well as parole and probation officers. I don't have an issue with herbal remedies however, within the eyes of the law, it's illegal.

The THC tests parole and probation officers use are to detect if THC is present, but not levels of intoxication like with breathalyzer or blood test.

I should have clarified that the levels of intoxication like with a alcohol breathalyzer or alcohol blood test. Yes, you can test for levels and amounts of THC but there isn't a test that links that to how high a person is. One of the main problems being is that a the THC metabolites can stay in a person's body a lot longer.

I truly enjoy interacting with members such as yourself, whereby instead of debating as most do, we straightened this out respectfully, as adults. I appreciate our exchange very much. it wouldn:t take my whole answer - One can be charge with poccession and being under the influcence for up to 30 days after smoking pot -- any drug consume you can Also be charged with both as long as it is in your system

You can only be arrested for possessing it, or possibly disturbing the peace.

If you are under the influence of drugs, they can easily tell. Your eyes will move involuntarily in a manner that's detectable and they can draw blood and test that also.

Law enforcement can tell if a person is under the influence of any type of drug. If they have any suspicion, or probable cause, an arrest can and will be made. Driving under the influence, which impairs a person's ability to drive, is illegal.

I think (not 100% sure) if you are stopped for driving erratically, whether under the influence of alcohol or something else, if they determine with their roadside tests that you ARE under the influence of something, they can arrest you. DUI is only "driving under the influence", not specifying what.

Could happen.....only proof is a blood test and highly unlikely unless you wre drawing attention to yourself because of it. The blood test would be needed to hold up a conviction but to be arrested for being high on pot alone I dont think happens very often

If your driving or are in possesion of it they can otherwise they have no proof
If its in your car they can search your car if your in " public domain" i/e roadways parkinglots anything besides private property unless its a game warden who can just about do whatever he wants

You would have to be questioned but you probably would be fine as long as you don't have any pot on you

yes it's called bodily possession. Depending on where you are from you can be arrested for being high but not having any on you personally.
