Married and having boyfriend's baby. What can my child's last name be?

I told my ex about the child before we announced it to family (at about 8 weeks) so that we could work out the divorce. We agreed to 50/50 the cost and start the process this month.In his state he can have the divorce done in 45 days. In my state it will take 10 months. He has recently stopped responding to me. My legal name is my full maiden with my ex last name not hyphenated. Will I be able to name my child after my boyfriend, the definite father? Or will I have to name my child after my ex? Or will I be able to name my child will my maiden name?

I have been through this and as long as the father signs the birth certificate and agrees u can give the baby your maiden name or your boyfriends last name. But if he don't agree the baby is born with your last name no matter what it is. If you get a divorce before the baby is born I would suggest taking back your maiden name for the babys sake.

Does he have to be there for the birth to sign the certificate then? He lives 1300 miles away and there is no way he would or would be welcome to come here.

you don't even have to put his name on the birth cerificate at all. And the baby will have your last name. I had my 2nd son his father wasn't there so I let my Husband at the time sign and he knew he wasn't the father. Just so my son could have my maiden name. Then in our divorce we both agreed he wasn't the father. My son is almost 11 now and his real fathers name is not on the birth certificate and he still has my maiden name.

The baby is my boyfriend's. I have not seen my ex outside of court since the day my tires burned out of the driveway. I want the last name to be my maiden-boyfriend's last name. My legal husband will not be present. I called my hospital and they told me I can name the child whatever I want but if i am still married then my full name and the legal father's full name will be on the birth certificate. That gave me relief. I can fix a birth certificate but to do a birth name change, birth certificate, paternity and divorce all at once would be even more complicated. I'm hoping he get's over himself and his "she is mine" act soon because I want to be done with him forever!

Can name it after your boyfriend. But I hope you teach your baby better morals!

I have been separated for two years and recently found my ex a few months ago...he was hiding after court a few months after separation, we separated for extreme abuse. We live in different states in the US. I have been wanting to get our divorce settled but with me moving a few times in the past years (no money or prospects due to classic abuser and no help afterwards hoping starvation and homelessness would force me to crawl back) I have not been able to file. I have been with my now boyfriend for a year and a half (we met months after I separated) and we are expecting a child in the next few months. I told my ex about the child before we announced it to family (at about 8 weeks) so that he would have time to process the situation and we could work out a game plan. We originally agreed to splitting the costs 50/50 and starting the process this month to have it done before the child is born. In doing so he will not have to pay for the DNA test, child support and lawyer fees.In his state he can have the divorce done in 45 days for $600 since we have been separated for over a year. In my state it will take 10 months after filing. He has recently stopped answering or responding to text, voice mail and emails. He is very possessive and I have the feeling he still believes "I am his". He did this during multiple court sessions and for months after the separation. When he feels he is losing control over something this is how he reacts to "make it go away and keep what is his legally". Needless to say I have not and will not go back to him. My boyfriend and I are having a child like I said. My legal name is my full maiden with my ex last name not hyphenated. Will I be able to name my child after my boyfriend, the definite father? Or will I have to name my child after my ex? Or will I be able to name my child will my maiden name?

Thanks. I am dropping my ex's last name asap. I have talked to my boyfriend and he is understanding and in agreement with naming the child my maiden with his last name. When we are married my last name will be the same as our child's.
