When 2 people are in a relationship and they have a child and the man leaves the relationship and moves to another state who has custody?

my child is with her dad that lives in Texas for the summer and I worry that he isn't going to bring her back even though I do talk to her everyday I feel like its not my fault that he left us and decided to move to another state away from his child

You have to go to court and settle which parent has custody. Just because you feel that he was the reason your relationship ended doesn't mean anything. Take him to court and ask the judge to give you full or half custody of the child. Either option make sure the child will still be able to see his father, that is crucial.

Be careful and seek legal advice. He may be able to get you for abandonment.

My child is 10 years old she is with me all the time she has only spent 2 summers with him altogether he wasn't suppose to take her this summer because he didn't have anybody to watch her but now he does have someone to watch her for the summer

Just keep good records. If you can have him put things in an email, it's best. Still I would talk to a lawyer or family advocate at family court.

I think the person that the child lives mostly with and the person that pays for her food, clothing, etc is the person that has custody of the child

i think who ever can support the kids the best but most of the time they end up going with their moms.

I'm surprised you didn't go to court to settle this dispute. either way your child will most likely stay with you. children usually always stay with their moms unless theulyre deemed incompetent to take care of the child. your husband can't keep your child especially if you accuse him of abandoning the home with a child. it seems to me like you have more of an advantage than he does.

Make sure you have all your paperwork in order to prove that you have been caring for your child, (receipts for clothing, school supplies, school records, report cards, phone records of this summer's phone calls, etc.) If he doesn't bring her back you've got a start on what you will need to get her back. If nothing happens and he does being her back go down to family court and have custody papers drawn up to protect yourself in the future. You probably should contact them sooner and see what you need to do to get things started.

both parents have custody however you will need to go court and file for legal custody this is just saying that the child lives with you however if he left the state for more than 30 days and didn't send and support then he abandoned the child however each start is different you stated that you send her to here dad for the summer you need to ask when will he be bringing her back when she returns file your paper work

It varies in different countries. If their is no claim made it automatically goes to the main care which is usually the mum. If the dad wants it he has to lodge a claim to have it heard in the family court. If he does this you should be notified of a date set for the hearing. If he doesn't return her without permission from the family court he will legally be in the wrong as far as I know. As others have said get your paperwork in order in case you need to deal with this in court. I wish you all the best.
