Can i evict my brother from my apartment without notice?

He said two weeks he'd stay and that was January. He's never paid rent or utilities, every so often he would buy food that i wouldn't eat and has said i OWE HIM for that food, which he got from food stamps. He is also a Junky and a drug dealer.

Yes you can kick him out at anytime. If he refuses to leave, call the police and let them remove him.

I have told him. He is now threatening to call my place of employment and my GF and say that im a drug user. I cannot afford to lose my Job. I have MS and he is stressing me on the verge of another relapse.

Since you didn't do anything at the end of the two week period, you allowed this living condition to develop into a non-verbal contractactual situation. That being civil you local cop shop will/can do nothing! If it we me is throw the numb out!

You have enabled him up to this point by letting two weeks turn into months .. and have created a dependency. He is an unwanted guest .. boot his butt to the curb .. and change your locks.

He has been living there quite a while. Think you have to give him a thirty day eviction notice! Inform your employer what is going on so that if he does call, they will know what they are dealing with. Good livk

Legally, no. Since he has been (however begrudgingly) living there all this time you have to do a legal eviction. You don't need an attorney. You go to the local court house and take out eviction papers. Different jurisdictions have different lengths of notice. Most run 30 days but you need to check your area as it could be longer.

I actually tole him two months ago if he didnt pay me by end of june he had to get out. I have proof of this message to him.
