I was recently arrested for curfew, and underage consumption. I was not breathalyzed.& the UC was not cited. Can I fight this in court?

I am under 18. The citation does not have anything related to the underage consumption of alcohol on it. I was not administered a breathalyzer. I admitted to drinking. What should I do?

The question wasn't a matter of me "putting my big kid pants in", it's a matter of whether or not I was capable of fighting the charge in court. Thank you for your answer.

You admitted to underage drinking so what do you plan on fighting? Your admission was your proof against yourself.

My admission wasn't in writing or in an affidavit so I was unsure. It was also not on the citation.

Was there another officer or witness present when you admitted it?

No. Only one officer was there. Until about a minute later.

Then yes, you can try to fight it. Although when you go to court the judge will ask you under oath. So it's up to you if you feel comfortable lying. Next time just be good or don't get caught. And don't admit it.

You can try to fight the charge, but keep in mind that the officer you dealt with only needs to make a sworn testimony. Since you're under the age of 18, the argument that the breathalyzer was not used does not really hold water.

You can fight anything you want to in court. The key is winning, which isn't likely! Cookie... is right, put on your big boy pants on learn from this and go on. If your under 18, and don't get arrested again it will not even be on your record!
