If a paternity test was falsified can the divorce settlement be contested or overturned in CA?

I took a paternity test for my daughter the test showed I was not the father. I was so emotionally broken from finding this information out that I allowed my ex to have everything in our divorce. Four years later I was contacted by my ex and was told I was the father. Since I have had my own paternity test done and I am in fact her father. I want to know if I can have the divorce settlement reversed since I only let her have everything due to the emotional devastation felt due to the fraudulent paternity results.

Testing is never 100% accurate, so unless you could prove that your ex somehow altered the test results, I don't know that you would have much of a case. Did she dispute the results at the time in any way?

You might have some recourse against the testing company though, but I don't know that you'd be allowed to change the terms of your divorce settlement, again unless you can prove that there was some sort of shady dealings going on with your ex. In either case though, you still agreed to the settlement, so it's hard to reverse that. Best bet would be to talk to your lawyer though.

You should talk to a lawyer and possibly request a re-trail (even though you never had a trial) to contest the settlement on grounds of fraud (falsified paternity test).
