Can i get my car back?

Im in NSW Australia. Recently I was scammed by a forged check. I sold my car by received a fake cheque(bank cheque not personal cheque). The bank claims that they don't have any responsibility on detecting Bank check. I thought i will never find my car anymore even i have reported this issue to the Police. Fortunately, my car has been displayed on Carsales yesterday, the dealer bought the car!

However, Police said that dealer is also victim, so it is unlikely that i can get my car back unless the court decided.

I need help, what can i do? Anyone? Is there any chance that i can get my car back?

yes the dealer busted for receiving stolen property. report the car stolen and tell the po po where it is

The police said that i can't report my car stolen, because it is not.

Don't advise people to file false police reports, it just makes things worse.

the dude didn't pay for the car he stole it. then sold it . how is that a false report . the first dude stole it

You can be able to get your car back because the buyer was a scammer. Once you have tracked it down, you can have the person you sold it to arrested by the police. Make sure that your lawyer is present when you go to make your claim so that he/she can represent you legally.

Police says that the dealer is also victim. Dealer will refuse to return the car since he has paid for the car

The laws are different in Australia than America.Contact someone local to see what your rights are.

He may be a victim. But he can not keep stolen properties as law of my country. I think you should go to a good lawyer and ask what you should do.There may be some things which cops don't know

In English common law a thief does not have good title and cannot sell his loot. Thus, the dealer's purchase was fraudulent and you should get the car back. However, you will need a lawyer to get this straightened out, since the police don't seem interested in doing their job.
