Can an employer hold your last check due to an unpaid loan to the company when there was never a payment agreement made,

Report as

The employer can hold your last check to cover the unpaid load even if there wasn't an agreement made. Since you are leaving the company without paying for the loan, the money in your last check should be used to settle that since you are no longer his employee. However, you should have discussed on how to repay the loan even if you did not have a written agreement.
