Sorry bud she had the right of way. Hope you have insurance. Although you might have a good case since she was leaving through the entrance. take some pictures of the entrance for the insurance company and pics of where you were stationed

Well if she did what you say she did, then she obviously is.

I guess she would be in the wrong, after all she was exiting an entrance, so isn't that kind of like driving down a one way street, the wrong way.

well that will be hard to answer if she was stopped and you backed into her then it was your fault if she was still going then it is kind of a toss up. I think in general it would be your fault because you were backing into a lane of traffic flow but she was going the wrong way. It would have been best to have police come to the scene because they can tell you who now you will have to let your insurance argue.

Sounds like you're both at fault. She shouldn't have been exiting thru the entrance, but you should have been able to stop before you hit her. Call your insurance company and explain the situation. Since the accident occurred on private property, did either of you get a ticket? If not, it will simply be your word against hers. That's why insurance companies have legal departments. When the claim is filed, your insurance company will subrogate against hers. Call your agent.

no ticket but it hurt my car more than her truck

There's not much you can do about it except let the insurance companies fight it out. Hope she has insurance, at least!
Report as
she has the same as i do she gave me her name and number and said she had the same insurance
Report as
If she was telling the truth, and you're both insured thru the same company, the insurance company will pay to fix your car, no matter who was at fault. Whether or not they'll drop you at renewal, or raise your premium thru the roof, will depend on how many other accidents, claims or tickets you've had.

Usually on private property cops have no say and insurance splits it.

You really should have called the police and had them straighten it out.

If you are backing up you need to be in control and look before you back up and are responsible if you back into someone. Since she was going the wrong way maybe the insurance will say 50 50 fault as she was wrong also, but those in a lane have right of way over those in a parking space. If she was going the right way you would be completely at fault.
